Alternative Dispute Resolution
This is an alternative to litigation. It covers both consensual and adjudicative processes. Consensual processes involve mediation, conciliation, or negotiation between parties, with the aim of coming to an amicable settlement. This sometimes involves the help of an independent facilitator. Adjudicative processes, however, involves arbitration which requires an independent third party to reach a final binding decision on a dispute between parties.
